1. The Service

QEAR provides an automated verification and grounded-citation layer for AI and text outputs. It assesses whether a claim is supported, refuted, or unaddressed by a reference source and returns a verdict with a citation or an abstention. QEAR is a software tool. It is not a law firm and does not provide legal, financial, medical, or other professional advice.

2. Accounts and API keys

You must provide accurate registration information and are responsible for all activity under your account and API keys. Keep your keys secret; you are responsible for use and charges until a key is revoked. Notify us promptly of any unauthorised use.

3. Acceptable use

You will not: submit content you have no right to submit; use the Service to build a competing product by systematic extraction; attempt to breach, overload, or reverse-engineer the Service; use it unlawfully; or submit special-category personal data without a lawful basis and a data-processing agreement with us.

4. Bring-your-own-key (BYOK)

Where you supply your own third-party model keys, you are responsible for those keys and your agreements with those providers. We use your key only to fulfil your requests.

5. Fees, billing, and refunds

Paid tiers are billed in advance on a recurring basis via Stripe at the prices shown at checkout. Fees are non-refundable except where required by law. You authorise recurring charges until you cancel; cancellation takes effect at the end of the current billing period. Quotas and rate limits apply per tier and reset each period.

6. Intellectual property

You retain all rights to content you submit ("Input") and grant us a limited licence to process it solely to provide the Service. We retain all rights to the Service, including our software, configuration, prompts, thresholds, and reference corpora.

7. Disclaimers — accuracy and no professional advice

The Service is provided "as is" and "as available." QEAR uses automated retrieval and language-model assessment, which can be incomplete or incorrect. We do not warrant that any verdict, citation, confidence score, or output is accurate, complete, or fit for any purpose. A result is an automated informational signal, not a determination of legal compliance, factual truth, or professional adequacy.

You must not rely on QEAR output as the sole basis for any legal, regulatory, financial, medical, safety, or other consequential decision. For such decisions you must obtain independent verification from a qualified professional. Citations are provided so you can check the underlying source yourself. To the maximum extent permitted by law, we disclaim all warranties, express or implied.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total aggregate liability for any claim is limited to the greater of the fees you paid us in the [3] months before the event or [€100]. Nothing limits liability that cannot be limited by law.

9. Indemnity

You will indemnify us against claims arising from your Input, your use of the Service, or your breach of these Terms, to the extent permitted by law.

10. Suspension and termination

You may cancel at any time. We may suspend or terminate access for breach, non-payment, or risk to the Service, with notice where practicable. Sections 6–9 and 11 survive termination.

11. Governing law

These Terms are governed by the laws of the Netherlands, subject to any mandatory consumer-protection rights you have where you live.

12. Changes

We may update these Terms; material changes will be notified with reasonable notice. Continued use after changes take effect constitutes acceptance.
